Why are the DraftKings and FanDuel betting apps legal in the United States?

Anybody who has tuned into the start of the NFL season this year can't have missed the wall-to-wall commercials for fantasy gambling sites like FanDuel and DraftKings. Can someone please explain to me why these sports betting sites are legal but regular online sportsbooks are illegal?

I'm tempted to sign-up but I'm afraid these sites will be shut-down and I'll lose all my money.

DraftKings and FanDuel make the argument that picking drafts is a game of skill so it is not subject to the same laws and regulations as regular sports betting. If these sites were offering just season drafts I don't think there would be a problem but since they offer daily betting competitions many people believe that they are gambling sites.

that argument doesn't seem to wash in N.Y. where the both sites were shutdown by a judge. it will be interesting to see how this plays out.

Draft Kings and FanDuel are now illegal in Louisiana, Montana, Quebec, Iowa, New York and Arizona and unfortunately, the list keeps growing.

Both DraftKings and FanDuel are available in the United Kingdom. UK citizens can now indulge in fantasy sports betting on the English Premier League and a whole host of other sports.

Republican Senator Tom Cotton from Arkansas introduced a bill to the senate recently that seeks to completely ban all forms of online gambling in the United States. Thank god for bitcoin!

The state of New York has now legalised daily fantasy sports betting but the two big players, FanDuel and DraftKings, will both have to pay a $6 million dollar fine for misleading advertising. Despite the hefty fine, I think both companies will be relieved that they can reenter the NY market.

DraftKings have confirmed that they are going to merge with FanDuel after an agreement was made. It's not yet clear whether they will merge the two brands or if they'll keep separate identities.
